1. Terms and Conditions

• 1.1 Governance

  These terms govern all our Services — laboratory testing, testing kits for saliva/stool samples — provided directly or through resellers/partners.

• 1.2 Applicability

  Read these terms carefully before ordering or registering. They cover who we are, how Services are provided, how contracts can change or end, and what to do if there’s a problem. Contact us if anything seems wrong. You must agree to use our Services.

2. Information about us and how to contact us

    We are Elev8 Health Pte. Ltd., a company incorporated in Singapore, with registration number (UEN): 202240256G. Our registered office is at 60 Paya Lebar Rd. #11-22 Singapore 409051. We presently operate brands and services including Elev8 Health™, Elev8 Care™, Live WYZR™, and GENIXPRO™

Please note that any interaction between us via social media will not be recorded as part of our quality systems and that any questions or complaints about these terms or the Services should be submitted to us by telephone, email or post.

  • 2.3 How we may contact you.

    If we have to contact you, we may do so by email at the email address you provided to us when you registered your user account (or when you have not registered a user account, the email address in your order).

  • 2.4 ‘Writing’ includes emails.

    When we use the words ‘writing’ or ‘written’ in these terms, this includes emails. Email is the preferred mode of communication between you and us.

3. Acceptance of Terms

• Applies worldwide, except jurisdictions restricting direct-to-consumer genetic data use.
• Covers: free account creation, sample submission, and uploading digital genetic/biomarker data.
• Accepted by clicking agree, acknowledging a consent document, or continued use.
• Also governed by the Privacy Policy and any posted rules/guidelines.

4. Eligibility

You may not use the Services if:

• You cannot form a legally enforceable contract;
• You are under 18 (or your jurisdiction’s age of majority); or
• Access is unlawful in your jurisdiction.

Personal use only — no business/commercial use without written authorization. Reseller purchases with eligibility issues should go through the reseller’s return policy.

5. Our Services

• Includes Website/App access, sample collection & Genetic Information analysis, provided “as is,” without warranty.
• Services may evolve with science, technology, and regulation — we may suspend/terminate access accordingly.
• You may stop anytime; subscribers must notify us before discontinuing.
• Service language: English.

6. Use of Personal Data

• Governed by our Privacy Policy (HIPPA/GDPR/PDPA/PIPEDA-compliant).
• Data/biomaterial may be processed in Asia.
• Privacy Policy covers: data/sample types collected, usage, storage location & duration (samples stored up to 1 year, extendable), security measures, access rights, and withdrawal procedures.

7. Accreditations

• Sample containers & testing software carry the CE Mark.
• Testing labs accredited to CLIA, CAP, ISO 15189 by a Notified Body.

8. Important Issues Regarding Services

Key acknowledgments:

• Genetic results cannot be “unlearned” — don’t assume positive outcomes.
• Sample processing may fail; a second attempt may incur a nominal fee; a second failure means another kit at a fee; a third failure means no further kits (or refund) available.
• For any reason, once refunded (partial, if applicable), future sample submissions are not accepted.
• Genetic sequencing isn’t error-free — no refunds for such errors.
• Do not change lifestyle/health behavior based on results without consulting a physician.
• Genetic risk is probabilistic, not deterministic — absence of risk ≠ immunity; presence of risk ≠ certainty.
• Genetic ethnicity research coverage is uneven across populations.
• Results may affect and be relevant to relatives — consider implications of sharing.
• Insurance implications: non-disclosure of known genetic risk to insurers may constitute breach/fraud.
• Services are informational, research, and educational only — not medical diagnosis or advice. Always consult a physician/genetic counselor.

9. Consent

By submitting a sample, you consent to Testing Services and confirm understanding of:

• Scope, accuracy, and limitations of testing;
• Results don’t replace physician consultations;
• Implications for you, relatives, and insurance;
• How to withdraw consent (see 15–16);
• Data/sample transfer in case of business ownership change;
• Separate consent required for future anonymized R&D use.

You also confirm:

• You’re of legal age;
• Samples are your own, unadulterated;
• Proper authorization if submitting on behalf of a minor;
• Consent to reanalysis if samples are damaged.

Note: Consent to testing does not grant you rights or compensation for resulting research/commercial products.

10. User Registration

• Must be 18+ to register (add minors under your main account with proper authorization).
• You’re responsible for account/password security and accurate information.
• Reseller-purchased kits with registration issues → refund (if any*) per 15.

11. Purchasing

• Available in: India, Singapore, Hong Kong, UAE, Indonesia, Malaysia, Thailand, Vietnam, Australia, and New Zealand only.
• Purchase via Website, App, direct contact, or authorized resellers.
• Registration mandatory regardless of purchase channel.
• Order acceptance = confirmation email; unaccepted orders may be refunded.
• Each order gets an order number (invoice/21CH ID).

12. Price and Payment

• Applies to direct purchases only.
• Prices as displayed at checkout (may exclude GST); GST-rate changes are passed on unless already paid in full.
• Pricing errors: lower correct price → you’re charged less; higher correct price → we contact you first; obvious mispricing already processed → we may cancel or initiate partial refund.

13. Delivery

• Delivery/return costs are included in the Testing Services price (partial refund on return, minus delivery/return/admin charges).
• Missed deliveries trigger re-arrangement instructions; repeated failure may end the delivery contract.
• Kit is your responsibility from delivery until we receive it back.

14. Providing the Services

• Contract of service begins upon barcode registration.
• Reseller purchase alone ≠ service contract — registration + our email confirmation is required.
• Contract of service ends when results are uploaded to your account.
• Subscription plan: new kit every 3 months, auto-charged; cancel anytime via email (processed within 10 business days).
• Delays outside our control: we’ll notify you; delays over 6 weeks allow cancellation + partial refund.
• We may suspend Services for technical/legal reasons or non-payment (14 calendar days after reminder).
• Online consulting: up to 30 minutes, must be used within 30 days of report upload.

15–17. Ending the Contract, Cancellation & Refunds

Right to cancel:

• 7 days from delivery (kits) or from order date (non-kit services).

No right to cancel if:

• Testing already completed; or
• Hygiene-sealed products have been unsealed.

How to cancel: Email (EHS@genixpro.com with subject keyword – ‘Notice of Cancellation’), phone (+65-88752304), or post.

Refunds:

• Not available once analysis has begun or seals are broken.
• We cover return costs only if the kit was faulty/misdescribed, or the change was our fault (pricing error, our-caused delay, terms change, etc.) — otherwise you pay return postage.
• Refunds processed within 14 business days of kit return or notice of cancellation.

Right to be forgotten: Email “Forget me” in the subject line to remove samples/data from our records.

18. Our Right to Make Changes

• Minor changes (legal compliance, small technical fixes) — no special notice needed.
• Significant changes — reasonable notice given; continued use = acceptance.

19. Our Right to End the Contract

We may terminate if you:

• Miss payment (7+ days after reminder);
• Don’t allow kit delivery in reasonable time;
• Don’t return samples in time;
• Return samples but don’t register the barcode within 14 days (sample destroyed); or
• Violate/are suspected of violating clause 23 (Prohibited Conduct).

20. Complaints

Email EHS@genixpro.com with “Complaint” in the subject. Reseller-purchased kits: return through the reseller.

21. Our Liability

• We’re liable for foreseeable loss from our breach or negligence — not unforeseeable loss.
• Not liable for: your password/account negligence, ignoring kit instructions, or unsupervised lifestyle/medication changes based on results.
• We don’t limit liability where unlawful to do so (death, personal injury, fraud).
• No liability for business losses — Services are for personal/domestic use only.

22. Other Important Terms

• We may assign this agreement (with notice); you need our written consent to assign yours.
• Severability: invalid clauses don’t void the rest of the contract.
• Delay in enforcement ≠ waiver of rights.
• Governing law: Singapore. Jurisdiction: Singapore courts.
• Disputes: Binding arbitration in Singapore (English language), with optional neutral evaluation first.

23. Prohibited Conduct

You agree not to:

• Use Services unlawfully or access unauthorized information;
• Infringe IP rights;
• Post unlawful, spam, defamatory, obscene, or harmful content;
• Harm minors;
• Sell/trade access to the Service;
• Harass or violate others’ privacy;
• Transmit viruses/malicious code;
• Impersonate others or disguise content origin;
• Bypass security features;
• Overload or interfere with Service operation.

Violation → account suspension/termination at our discretion.

24. Export Control

You must comply with applicable export control laws and not cause us to violate any related regulation.

25. User Generated Content

• We don’t control or guarantee accuracy of user generated content.
• We may (but aren’t obligated to) review, modify, or remove content violating these terms.

26. Waiver of Proprietary & Moral Rights

• No compensation for research/commercial products developed from your data.
• You waive all rights in resulting products and moral rights (attribution, integrity, etc.) under applicable copyright law.

27. Indemnity

You agree to indemnify us against damages/claims arising from:

• Your breach of these terms;
• Disclosure of your genetic/testing results to third parties;
• Your User Content or Service use violations.

28. Resale or Gifting

• No unauthorized distribution/resale of the Service.
• Must be purchased through approved sources; unauthorized purchases may be declined at our discretion, with no guaranteed refunds.

29. Usage Limits & Storage

We may set access limits, data retention periods, and storage caps — and change these anytime without prior notice, subject to law. We’re not responsible for data loss due to server issues or standard retention policy enforcement.

30–31. Termination & Survival

• Either party may terminate (you: in writing; us: for breach, supplier withdrawal, market exit, non-viability, suspected fraud, or legal requirement).
• Termination doesn’t erase prior obligations/accrued rights.
• Surviving clauses: 6, 8, 9, 21, 22, 27, 30, 33, 34, 35.

32. Third-Party Links

We’re not responsible for content/damage from linked third-party websites/resources.

33. Our Intellectual Property

• We own all IP in the Services — no modification, resale, reverse-engineering, or derivative works without authorization.
• Trademarks: Elev8 Health, Elev8 Care, Live WYZR, 21ST Century Health Analytics, GENIXPRO™, NYAH™ — unauthorized use prohibited.
• By submitting User Content, you grant us a broad, perpetual, royalty-free license to use it.
• You own your Genetic/Self-Reported Information but grant us a similar license for de-identified, aggregated use to improve Services.

34. Disclaimer of Warranties

Services provided “as is” — no guarantee of uninterrupted, error-free, or secure access; no liability for viruses, identity verification, or user-uploaded content issues. All statutory warranties are disclaimed to the maximum extent permitted by law.

35. Limitation of Liability

• No liability for incidental, special, punitive, or consequential damages.
• Total liability capped at amounts paid in the preceding 12 months.
• No liability for password negligence, third-party actions, unauthorized data access, or substitute goods/services costs — unless due to our negligence.
• Exceptions: death/personal injury from our negligence, fraud, or non-excludable statutory liability.

36. Notices

• Email notices: EHS@genixpro.com and your last-known email — deemed received at transmission (unless bounced).
• Postal notices: deemed received 9am on the 5th business day after posting.
